Acceptance of Terms
These Terms of Service ("Terms") are a legal agreement between you and Two Left Shoes LLC ("Two Left Shoes," "we," "us," or "our") governing your access to and use of the MyRickhouse mobile app, MyRickhouse.com, related support channels, email communications, website forms, merchandise offerings if available, and related services (collectively, the "Services").
By accessing or using the Services, creating an account, signing in, confirming legal drinking age, or clicking or tapping an acceptance button, you agree to these Terms and to the MyRickhouse Privacy Policy. If you do not agree, do not use the Services.
Eligibility and Legal Drinking Age
MyRickhouse is intended only for people who are of legal drinking age in their location. You may not use the Services if you are not of legal drinking age. If you are located in the United States, you must be at least 21 years old to use the Services.
By using the Services, you represent that you are of legal drinking age where you live and where you use the Services, and that you have the legal capacity to enter into these Terms.
Responsible Use; No Alcohol Sales
MyRickhouse is an organizational, logging, recommendation, and social app for bourbon and American whiskey enthusiasts. The Services do not sell alcohol, process alcohol transactions, arrange alcohol delivery, verify alcohol inventory at retailers, or facilitate the purchase of alcoholic beverages.
You are solely responsible for complying with all laws and rules that apply to alcohol possession, consumption, transportation, purchase, sharing, and use in your location. Use MyRickhouse responsibly. Do not use the Services in a way that encourages underage drinking, excessive drinking, unsafe behavior, or illegal activity.
Accounts and Security
You may need an account to use the Services. You agree to provide accurate information, keep your login credentials secure, and notify us promptly if you believe your account has been compromised.
You are responsible for activity under your account, except where caused by our failure to use reasonable security measures.
User Content and License
The Services may allow you to enter, upload, store, or share bottle information, collection information, pour logs, ratings, tasting notes, taste profiles, texture selections, locations, feedback, messages, display names, handles, and other content ("User Content").
You retain ownership of your User Content. You grant us a worldwide, non-exclusive, royalty-free license to host, store, copy, process, transmit, display, and use your User Content as needed to provide, secure, support, and improve the Services, including social sharing features you choose to use.
You represent that you have the rights necessary to submit your User Content and that your User Content does not violate law, infringe rights, or harm others.
Feedback
If you submit feedback, ideas, bug reports, suggestions, or other comments about the Services, you grant us permission to use them without restriction or compensation to you. We may use feedback to improve, modify, and develop MyRickhouse and related products.
Acceptable Use
You agree not to misuse the Services. Prohibited conduct includes attempting to access accounts or systems without permission; interfering with security or operation; scraping or harvesting data without permission; submitting false, abusive, unlawful, infringing, or harmful content; impersonating others; harassing users; promoting illegal activity, underage drinking, or excessive alcohol consumption; reverse engineering the Services except where law allows; or using the Services in a way that violates applicable law or these Terms.
Social Sharing
If you share pours or other content with friends or groups, you are directing us to make that content available to the selected recipients. You are responsible for the content you choose to share and the recipients you select.
We may remove or restrict content or accounts if we believe they violate these Terms, create risk, or may harm users or the Services.
App Recommendations and Information
MyRickhouse may provide random selections, recommendations, bottle insights, aggregate ratings, taste profile information, or other app-generated suggestions. These features are for entertainment and organizational purposes only. They are not professional, medical, legal, safety, or alcohol-consumption advice.
Bottle information, proof, size, edition, batch, catalog metadata, ratings, and recommendations may be incomplete, inaccurate, or out of date. You should verify important information independently.
Email Communications
We may send transactional, support, account-related, security, legal, product update, newsletter, marketing, promotional, or sponsored communications where permitted. You may unsubscribe from non-transactional emails at any time using the unsubscribe link included in the email or by contacting us.
Unsubscribing from non-transactional communications does not prevent us from sending important account, security, legal, transactional, purchase-related, or support communications when necessary.
Sponsored Content, Advertising, and Third-Party Offers
The Services, MyRickhouse.com, and emails we send may include sponsored content, paid placements, advertising, affiliate-style links, partner offers, promotions, or links to third-party websites, products, or services. Sponsors, advertisers, partners, merchants, or other companies may pay us to include those items.
Sponsored content, advertisements, paid placements, partner offers, and third-party links are provided for informational, promotional, or convenience purposes. Unless we expressly state otherwise, third-party offers, products, services, websites, prices, availability, claims, fulfillment, warranties, refunds, customer service, and business practices are provided by the third party, not by MyRickhouse or Two Left Shoes LLC.
We do not sell, rent, trade, share, or give users' personal information, email addresses, account information, collection data, pour history, ratings, tasting notes, friend or group information, or other user data to sponsors, advertisers, partners, merchants, or other companies for their own marketing purposes.
If you click a third-party link, visit a third-party website, respond to a third-party offer, or purchase from a third party, your interaction is between you and that third party and may be governed by that third party's own terms, privacy policy, refund policy, shipping policy, and other rules. You should review those terms and policies before engaging with the third party.
Merchandise and Non-Alcohol Products
MyRickhouse may offer branded non-alcohol merchandise through MyRickhouse.com or a third-party storefront. Merchandise may include apparel, hats, clothing, accessories, barware, coasters, drink-service items, and similar branded products. MyRickhouse merchandise offerings do not include alcoholic beverages.
Merchandise purchases, if available, may be processed, fulfilled, shipped, taxed, refunded, or supported by third-party storefront, payment, tax, shipping, fulfillment, or customer service providers. Those providers may receive information reasonably necessary to process and support the order, but they are not receiving MyRickhouse app user data for their own marketing purposes.
Product descriptions, availability, pricing, shipping times, taxes, return eligibility, and fulfillment details may change. Additional store terms, payment terms, return policies, shipping policies, or provider terms may apply to merchandise purchases.
Account Deletion and Anonymous Aggregate Retention
You may initiate account deletion in the app. When deletion is completed, we delete or purge your account, profile, user-linked collection data, pour history, friends, groups, shared-pour data, and other user-specific records that are not required for legitimate legal, security, or business purposes.
You acknowledge and agree that MyRickhouse may retain anonymous, non-identifying bottle-level rating, texture, and taste profile contribution data after account deletion to improve bottle insights, aggregate trends, and recommendations. This retained data is designed not to identify you and is not used to recreate your account.
Privacy
Our Privacy Policy explains how we collect, use, disclose, retain, and protect information. By using the Services, you agree that we may process information as described in the Privacy Policy.
Ownership of the Services
The Services, including software, designs, logos, trademarks, text, graphics, visual design, features, and other materials, are owned by Two Left Shoes LLC or its licensors and are protected by intellectual property and other laws. Except for rights expressly granted in these Terms, we reserve all rights in the Services.
Third-Party Services and Links
The Services may link to or depend on third-party services, platforms, websites, app stores, authentication systems, infrastructure providers, email providers, storefront providers, payment processors, shipping or fulfillment providers, analytics providers, security providers, support tools, or other tools. We are not responsible for third-party services, and your use of them may be governed by their own terms and policies.
Nothing in these Terms makes MyRickhouse responsible for third-party products, services, offers, websites, advertisements, sponsored content, payment processing, order fulfillment, shipping, returns, warranties, representations, or customer service unless we expressly state otherwise in writing.
Changes to the Services
We may modify, suspend, or discontinue some or all of the Services at any time. We may add, remove, or change features, limits, or requirements. We will try to provide notice when changes materially affect users, but we are not required to provide notice for every change.
Termination
You may stop using the Services at any time and may delete your account through the app. We may suspend or terminate access if we believe you violated these Terms, created risk, used the Services unlawfully, or harmed users, us, or the Services.
After termination or deletion, provisions that by their nature should survive will survive, including ownership, feedback rights, disclaimers, limitations of liability, anonymous aggregate retention, dispute provisions, and any obligations that accrued before termination.
Disclaimers
The Services are provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Services will be uninterrupted, secure, accurate, complete, or error-free.
Limitation of Liability
To the fullest extent permitted by law, Two Left Shoes LLC and its owners, officers, employees, contractors, agents, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, loss of goodwill, or service interruption, arising out of or related to the Services or these Terms.
To the fullest extent permitted by law, our total liability for any claim arising out of or related to the Services or these Terms will not exceed the greater of the amount you paid us for the Services in the twelve months before the claim or one hundred U.S. dollars (US $100).
Indemnification
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Two Left Shoes LLC and its owners, officers, employees, contractors, agents, and service providers from claims, damages, liabilities, losses, and expenses, including reasonable attorneys' fees, arising out of or related to your User Content, your misuse of the Services, your violation of these Terms, your violation of law, or your violation of another person's rights.
Governing Law and Venue
These Terms are governed by the laws of the Commonwealth of Kentucky, without regard to conflict-of-law principles, except to the extent applicable law requires otherwise. Subject to any non-waivable consumer protection rights, you agree that disputes will be brought in the state or federal courts located in Kentucky, and you consent to personal jurisdiction and venue in those courts.
Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date and may provide additional notice where appropriate. Continued use of the Services after updated Terms become effective means you accept the updated Terms.
